The Al Dhafra Court of Appeal has rejected a woman’s lawsuit seeking AED 375,000 compensation from her brother for the construction of a ‘Chalet’.
The plaintiff said that during her father’s life, she intended to build a recreational “Chalet” built on a plot of land belonging to her brother.
This construction plan cost her AED 357,000 and she asked her brother to pay her the amount but he refused and prevented her from entering the Chalet.

However, the appellee said the building was constructed with funding from his deceased father.
The judge assigned a committee of experts who reported that the total costs amounted to AED 555,000, and that the plaintiff transferred AED 357,000 to the contractors.
The court held that the chalet was built with funding from both the father and his daughter and obligated the brother to pay AED 357,000 and a 4% legal interest.

The brother appealed the ruling noting that the plot of land was not owned by him but by the government and his father granted his sister a general power of attorney and she managed his accounts. He noted that the buildings on land allocated to him were funded by his father and not by his sister.
The Al Dhafra Appellate Court affirmed that the plot of land was owned by the government and overturned the initial ruling and obligated the plaintiff to pay the fees and expenses.
