Dear TFT,
Q: I work for a company in Deira Dubai. I have just resigned from my company. My employer is not ready to provide me with the final salary and gratuity. What options do I have to get my dues?
A:
Your gratuity depends on the term of your employment contract. Therefore, first check the term period of your employment contract.
Accordingly, you should plan your resignation. If you are under a limited-term contract and resign a continuous period of service without exceeding five years, you don’t have the right to get gratuity (Article 138).
If you have legal rights for salary and gratuity and your employer is not ready to pay your final settlement amount, then you can file a complaint.
Don’t sign your cancellation paper that includes no-dues paper until you get your final settlement. You may approach MOHRE to file a complaint at 80060.
