KNOW THE LAW: Will I get my end of service benefits if I resign while I am out of the UAE?

Dear TFT,
I have been employed with a Dubai firm for nearly 30 years.

I remain stranded in the Philippines due to the COVID-19-related travel restrictions in my area.

Now, I am thinking of resigning. Is it possible for me to claim my end-of-service benefits, including gratuity, without travelling to the UAE?

Answer:

You can receive your end-of-service benefits if you and your employer are mutually agreeing to settle amicably.

You may also file a complaint online, but to settle the matter, you are required to talk with the Ministry of Human Resources & Emiratisation (MOHRE) legal advisor.

Otherwise, your complaint may be closed.

Therefore, you need to be physically present here to represent in the court or appoint a lawyer to represent your matter by a Power of Attorney.
