Atty. Jesus Nicardo Falcis III, the brother of Kris Aquino’s former project manager Nicko Falcis, issued a statement regarding the legal complaints that the latter filed against his brother.
It can be recalled that Kris filed qualified theft charges against Nicko after he allegedly siphoned off money from her business for personal use.
Kris said in her complaint that Nicko charged P1,270,980.31 to the credit card of her production company, Kristina C. Aquino (KCAP) Productions, for personal expenses without her consent.
The well-known television personality submitted her separate complaints before city prosecutors in Mandaluyong, San Juan, Taguig, Pasig, Makati, Manila, and Quezon City, according to her camp.
Aquino filed charges for 44 counts of qualified theft against Falcis under Article 310 in relation to Articles 308 and 309 of the Revised Penal Code and for violation of the Access Devices Regulation Act of 1998.
After the news broke out, Atty. Jesus Nicardo, spoke on behalf of his brother and strongly denied such charges.
In a video posted by PEP.ph, Atty. Jesus Nicardo said that his brother chose to move abroad, not because he was trying to get away from the charges against him, but because he has been receiving threats from Kris.
“Miss Aquino threatened my brother. She said, ‘You [explicit] Nicko! Wag kang tatapak dito sa Pilipinas. Dare to step into this country and you will be dead.’ With threats coming from the daughter and sister of former presidents, we do not take lightly,” he said.
Atty. Jesus Nicardo added that Kris also possesses a list of his brother’s flight records meaning she can track when he will be flying in and out of the country. According to Atty. Jesus Nicardo, Kris has also bragged about her “powerful” friends who can impose threats on his brother’s safety and he claims that he has screenshots to prove it.
Due to the threats his brother has been receiving, Atty. Jesus Nicardo said that Nicko will not be present during the preliminary investigations.
Atty. Jesus Nicardo also said that Kris has defamed his brother’s reputation on social media by posting “baseless and totally ridiculous” accusations.
“She said that tens of millions of pesos were stolen from her, and suddenly, all she ever filed were cases of qualified theft for the total amount of P1.2 million. The charges are baseless and totally ridiculous,” he said.
Atty. Jesus Nicardo, being a lawyer himself, said that the qualified theft charges Kris filed are ridiculous since she only presented credit card statements.
“These are all ridiculous credit card charges. Qualified theft, for a lawyer like me, kailangan pong may physical taking para masabing nakaw. How can you steal a credit card charge? And all of the credit card charges were authorized,” he said.
He also said that there are questions that would be clarified better if they were answered by his brother himself, and Nicko will be ready to do so when he returns to the Philippines once his safety is secured.
Atty. Jesus Nicardo also said that his family tried to talk to Kris to settle the case, but the television personality decided to push through with the filing of her complaints in the middle of their negotiation.
At the end of his statement, Atty. Jesus Nicardo said: “To reiterate, my brother, Nicardo Falcis II did not commit 44 counts of qualified theft under Article 310, in relation to Article 308 and 309 of the Revised Penal Code, whether for P1.2 million or any amount. All of the details of these cases will be itemized in out legal when we file our counter affidavit soon enough which the media can obtain from the prosecutors after we file.”
