Dubai cancels deportation of drug convict under new law

A Dubai court has cancelled the deportation of a drug convict, in effect of the new anti-narcotics law.

The Dubai Court of First Instance initially ordered AED5,000 fine and deportation for a 38-year-old Indian expat in March last year. He was caught with two types of narcotics. He later tested positive for a urine drug test.

However, the court cancelled the deportation order on February 7, after his appeal citing Article 75 of the new anti-narcotics law.

The new legislation removes the previous mandatory deportation of expats convicted of personal drug use and possession.

“The accused has been residing in the UAE for over 30 years with a legitimate source of income,” his lawyer said in a statement, noting that the expat had no prior criminal record.

“He also helps manage his father’s business. Deporting him splits the entire family, who has been based here for the last 30 years and lost touch with their homeland,” she added.
