Senators expressed differing views on Senate Bill 372, filed by Senator Robin Padilla, which seeks to amend the Juvenile Justice and Welfare Act of 2006 (RA 9344) by removing exemptions from criminal liability for offenders aged 10 to 17 accused of heinous crimes. These crimes include murder, parricide, kidnapping with killing or rape, robbery with homicide, destructive arson, rape, carnapping with killing or rape, and certain drug offenses punishable by more than 12 years in prison.
Padilla acknowledged the controversial nature of the proposal, arguing that some minors are fully aware of their actions despite their age.
Senator Francis “Kiko” Pangilinan opposed the change, saying 10 years old is too young, and stressed that proper implementation of the current law is the real solution.
Senator Raffy Tulfo supported the bill, citing cases where minors were involved in serious crimes, leaving victims’ families without justice. Senator Erwin Tulfo called for more rehabilitation centers and juvenile facilities, suggesting that the DSWD be given funding to build them in every city and municipality.
Senator Sherwin Gatchalian favored a law that prioritizes rehabilitation and reintegration of children, emphasizing the importance of prevention programs and support for reforming young offenders.
