COMELEC division junks final disqualification case vs. Bongbong Marcos

The Commission on Elections First Division has junked another disqualification case against presidential candidate Bongbong Marcos.

The division junked the petition due to ‘lack of merit’.

“WHEREFORE, premises considered, the instant Petition, is hereby DENIED for LACK OF MERIT,” the decision read which was released on Wednesday.

Comelec Commissioners Socorro Inting, Aimee Ferolino and Aimee Torrefranca-Neri signed the decision of the division.

Pudno Nga Ilokano (Ang Totoong Ilokano) filed the petition which stemmed from Marcos Jr.’s conviction in tax-related cases in 1995.

The Comelec said that non-filing of income tax returns does not fall under moral turpitude.

“If failure to file income tax return is considered alone, it would appear that it is not inherently wrong. This is supported by the fact that the filing of income tax return is only an obligation created by law and the omission to do so is only considered as wrong because the law penalizes it,”
the Comelec said.

Another disqualification case was also junked against the late dictator’s son in February involving the non-filing of his income tax returns.
