A Dubai court has dismissed a trademark infringement lawsuit after the claimant failed to pay the required Dh60,000 deposit for a court-appointed expert.
The court ruled that the failure to secure technical evaluation meant the claimant forfeited the right to rely on expert findings, which are crucial in complex trademark disputes.
The case involved allegations of unauthorized use of a registered trademark on products and advertisements, but the court found the submitted evidence insufficient without expert analysis.
Judges emphasized that the burden of proof lies with the claimant and that liability cannot be established without clear and conclusive evidence.
As a result, the lawsuit was dismissed, with the claimant ordered to pay all legal costs and expenses.
