Motorists to pay less blood money depending on pedestrian’s actions

Drivers causing the death of a pedestrian could pay less in blood money in case the victim is found to be partly responsible for the accident, according to a legal expert.

Lutfi Hussein, a Sharjah-based lawyer, said traffic police rely on eyewitnesses and security cameras in investigating road mishaps in order to determine responsibility.

He said that in case a pedestrian is found to be fully responsible and that the driver could not avert the accident, there will be no legal action against the motorist.

As for the ‘diya’ or blood money, it is up to the court to determine the amount paid by drivers who cause deaths on roads; Hussein wrote in the Arabic language daily Emarat Al Youm.

“Courts depend on police reports in determining the diya… in case the driver is totally responsible for the accident, he will fully pay diya,” he said.

“In case he is partly responsible, and the victim was found to have abused road rules, then the court will determine how much the driver will pay.”

Diya, the blood money paid by a killer to a victim’s relatives in line with Islamic law, is officially set in the UAE at Dh200,000.
