Rappler files petition over SEC decision to revoke license

Online news portal Rappler has filed a petition before the Court of Appeals (CA) on Monday, January 29, to review the Securities and Exchange Commission’s decision to revoke its registration.

According to Rappler, the state regulator applied a different procedure in its case, depriving the news organization’s rights to equal protection of laws.

In its petition, Rappler stated that the panel created by the SEC to examine the organization’s structure were only able to determine if there was sufficient basis to initiate administrative charges.

Rappler lawyers also claimed that there was no due process following the SEC’s decision.

It also cited Article 1158 of the Civil Code stating that “if an act punishable by law has not been performed, then, the corresponding penalty under the law cannot be applied to one accused of violating it.”

SEC revoked Rappler’s registration on January 11, after allegedly violating the Anti-Dummy Law which prohibits foreigners from intervening in the management, operation, administration, or control of any nationalized activity.
