Fullido files motion for reconsideration after dismissal of libel raps vs. 3 colleagues

ABS-CBN entertainment news reporter has filed a motion of reconsideration at the Quezon City Prosecutor’s Office after her libel complaints against her colleagues have been dismissed.

The legal counsel of Fullido, Lawyer Eldrige Marvin Aceron, said that they have decided to appeal the case to keep it alive.

“We have filed this afternoon our Motions for Reconsideration on the resolutions of the Quezon City Prosecutor’s Office regarding the cases filed by Gretchen Fullido for Libel,” Aceron said in a statement.

“Please do not be misled into believing that the cases have been dismissed with finality. The filing of the Motions for Reconsideration, ten days from receipt, keeps the cases alive,” he added.

It can be recalled that the Quezon City Prosecutor’s Office has junked the libel charges filed by Fullido against journalist Ces Drilon, reporter Marie Lozano, and news executive Venancio Borromeo.

Prosecutors have decided to dismiss Fullido’s case saying the respective sworn statements of Drilon, Lozano, and Borromeo about Fullido submitted to the ABS-CBN Ad Hoc Investigating Committee are “not defamatory and malicious”, reported ABS-CBN.

In the resolutions, the Prosecutor’s Office stated that dismissing the charges citing the “doctrine of privileged communication” which means “statements may not be actionable for libel if some requisites are present.”

“While we commend the Office of the City Prosecutor of Quezon City in resolving the cases with dispatch, we regret that we cannot accept an erroneous resolution. Thus, we trust that our Motions for Reconsideration will be heard,” it added.
