Prosecutor junks Kris Aquino’s qualified theft charges vs. Nicko Falcis anew

The Pasig City Prosecutor’s Office dismissed the qualified theft charges filed by television and social media personality Kris Aquino against her former project and endorsement manager Nicko Falcis.

The news about Pasig City Prosecutor’s Office’s decision came after the Makati Prosecutor’s Office had already dismissed the same case filed by Aquino.

It can be recalled that Aquino personality submitted her separate complaints before city prosecutors in Mandaluyong, San Juan, Taguig, Pasig, Makati, Manila, and Quezon City, according to her camp.

Aquino filed charges for 44 counts of qualified theft against Falcis under Article 310 in relation to Articles 308 and 309 of the Revised Penal Code and for violation of the Access Devices Regulation Act of 1998.

The city prosecutors in Mandaluyong, San Juan, Taguig, Manila, and Quezon City have not yet ruled their respective decisions.

In the resolution of the Pasig City Prosecutor’s Office, signed by Senior Assistant City Prosecutor Aileen C. Sabare, they decided to dismiss Aquino’s case due to “insufficiency of evidence”.

The resolution reads:

“From the definition, it appears that the credit card used by respondent was neither stolen, revoked, canceled, suspended, or obtained with intent to defraud.

“The credit card was voluntarily issued to respondent under his name.

“Thus, when the respondent used the credit card for purchases at Lucendi and Toby’s Estate in Pasig City, the credit card cannot be considered unauthorized within the tenets cited by law.

“WHEREFORE, it is resolved that the charges against respondent for Qualified theft and Violation of R.A. 8484 be DISMISSED FOR INSUFFICIENCY OF EVIDENCE.”

Aquino filed qualified theft charges against Falcis after she accused him of using a credit card intended for her production company for personal use.
