Kris Aquino issues statement after court dismisses her charges vs. Nicko Falcis

The Makati Prosecutor’s Office has dismissed the complaints filed by Kris Aquino against her former project and endorsement manager Nicko Falcis.

It can be recalled that Aquino filed qualified theft charges against Falcis after she accused him of using a credit card intended for her production company for personal use.

However, the Prosecutor’s Office dismissed the case saying that the credit card was issued to Falcis’ name, meaning “he can use the card for his purchases” to the terms and conditions set by the issuing bank.

The court added that “no proof was presented that he used the card with intent to gain or intent to defraud.”

Falcis is only liable to pay for his bills which have since become due.

However, it seems that the Queen of All Media is not pleased with the decision as her camp said that she will be filing an appeal to reconsider her complaints.

Aquino’s legal team from the Fortun Narvasa and Salazar Law Office said through a statement that the court’s decision was “irregular and legally flawed.”

Aquino’s team said that Falcis name was included in the credit card to “show he was authorized to use it for Ms. Aquino, but not for his personal transactions.”

“He also tried to pay part of it by using his own check to cover the cost of his personal purchases. His admissions to wrongdoing were all submitted in evidence to the prosecutor who may have glossed over those,” the statement added.

Aquino’s legal team also said that he did not file a counter affidavit to refute the charges against him.

“His defenses are only his own allegations, the truth of which should be proved during trial. The task of the prosecutor is to determine whether or not there is probable cause to charge him of these offenses,” the statement continued.

Aquino’s legal team said that they would “ensure that justice is served for Ms. Aquino.”
